Terms of Service

These Terms of Service ("Terms") govern your use of this website and any project request submitted to DigitalbyND ("we", "us", "our") through our contact form. By submitting a request, you agree to these Terms.

1. Services

We provide website design and development services, including but not limited to new website creation, mobile optimization, social media setup, Google Business Page setup, and SEO (Search Engine Optimization).

2. Project Requests & Quotes

Submitting the contact form does not constitute a binding agreement. After reviewing your request, we will contact you within 24 hours to discuss project scope, timeline, and pricing. A project only begins once both parties agree on the scope and the initial payment has been received.

3. Pricing & Payment Terms

Our starting price is $800 per project, subject to change based on project scope and requirements. Payment is split as follows:

• 50% upfront — due before work begins
• 50% on delivery — due once you approve the completed website

All payments are processed securely through Stripe. Prices are quoted in USD unless otherwise agreed.

4. Delivery Timeline

Our standard delivery target is 48 business hours from the confirmed start of the project. This timeline may vary depending on project complexity, the responsiveness of the client in providing content/feedback, and the scope agreed upon. Any change in timeline will be communicated to the client.

5. Revisions & Approval

Upon delivery, the client will review the completed website. Reasonable revisions related to the originally agreed scope will be made prior to final approval and final payment. Requests that materially expand the original scope may be subject to additional fees.

6. Cancellations & Refunds

If a project is cancelled by the client after the upfront payment has been made but before delivery, the upfront payment is non-refundable, as it covers work already committed and/or in progress. If we are unable to deliver the agreed project, the client is entitled to a full refund of the upfront payment.

7. Client Responsibilities

The client agrees to provide necessary content (text, images, branding materials) and timely feedback needed to complete the project within the agreed timeline. Delays caused by the client may extend the delivery date accordingly.

8. Intellectual Property

Upon full and final payment, ownership of the final website deliverable transfers to the client. DigitalbyND retains the right to showcase completed projects in its portfolio unless otherwise agreed in writing.

9. Limitation of Liability

DigitalbyND is not liable for any indirect, incidental, or consequential damages arising from the use of the delivered website or services. Our total liability is limited to the amount paid for the specific project.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
